Bands Legal Definition

“This definition and a very cursory examination of Indian law make it clear that an Indian band is indeed a legal entity composed of specially defined `persons` with extensive powers of ownership and regulation over its members. The Peter Ballantyne Band is clearly a unit that can own property, including motor vehicles. In R v. Peter Ballantyne, Noble J. wrote of this legal definition: “I interpret the Indian Act definition of band to mean a group of persons or a group that are considered to be a single entity, that satisfy the reserve interest portion of the definition, or that participate equally in the distribution of pensions or interest money, for which the government is responsible, including contractual pensions. “Band means a body of Indians whose use and benefit in community lands to which Her Majesty is entitled by legal title, before, from the 4th century or after. It was separated in September 1951; for the common use and benefit of funds held by Her Majesty; be declared a band by the Governor to the Council for the purposes of this Act. Our review team has selected the best resistance bands. They do not refer to magnetic tapes on which sounds are recorded as “tapes”.

They call them ribbons. In Montana Band, ¶454, Hansen J. interpreted the otherwise indefinite word band as used in the Indian Act as follows: 15th century, in transitive sense 1, The Indian Act of Canada, in subsection 2(1), defines a band as follows: “[T]he Indian band is a legal entity, such a status does not necessarily bring it to the Companies Act. Its status in terms of meaning is more similar to that of a trade union, which also has an independent legal status but does not fit into the Companies Act or function as a company. Neither a band nor a union is formed by a founding act, but each of them exercises a representative function on behalf of its members and each is a legal person. A ribbon is a narrow strip of material such as fabric or metal that is connected to the ends so that it can be firmly attached around something. “The group is. acts as a manager or representative. A group is not a human being.

Note: The meaning of the Latin word is well illustrated by the following passage from the late eighth-century history of the Lombards Paul the Deacon (Historia Langobardorum, 1.20): “Tato vero Rodulfi vexillum, quod bandum appellant, eiusque galeam, quam in bello gestare consueverat, abstulit.” (“Tato [a Lombard king] actually carried the banner of Rodulf [a king of the Heruli, a Germanic people], which they call bandum, and his helmet, which he used to wear in battle”) The presumption is that the standard, which served as a gathering point or gathering point for a group of soldiers, was applied to the group itself, and the meaning was generalized to any partnership. The Gothic word bandwo is generally considered to be derived from the Indo-European *bheh2- “to shine, to give light, to appear” (see fantastic entry 1), although the derived details are missing. D. Kroonen (Etymological Dictionary of Proto-Germanic, Brill, 2013) sees it as coming from *bhonh2-tuÌ ̄ã©h2, from the basis of the Germanic *bannan- “to speak formally, to call, to order” (from *bhonh2-e-, by Kroonen; see prohibition entry 1). The Gothic name has a verbal derivative bandvyan “to give a sign, to reveal”, with a form of prefix gabandvyan. The verb is supplemented by the Old Icelandic benda “to undulate, give a sign, predict,” apparently the only other Germanic proof of Etymon.
